1. Scope of application
These General Terms and Conditions (GTC) apply to the entire business of SAYNQUE GmbH, Webereistrasse 47, 8134 Adliswil (‘AYRE’). The company owns and operates the online shop www.ayre.ch. The associated terms and conditions of purchase can be found on the www.ayre.ch website. These terms and conditions apply to the above-mentioned areas as well as to the other services that the company provides directly and indirectly to the customer.
2. Conclusion of contract
The contract is concluded as soon as the customer places his order in full and thus agrees to the terms and conditions, as well as by the express shipping confirmation to the customer with the listed products. The order is not yet a binding promise that the ordered items/products are actually available or can be delivered. As soon as SAYNQUE GmbH has received payment for all products and any delivery costs, the products will be packed and shipped.
3. Prices
All prices and products are subject to change. Unless otherwise stated, all prices are in Swiss francs (CHF). The company reserves the right to change prices at any time. The prices valid at the time of the conclusion of the contract on the website www.ayre.ch or according to the company's separate price list apply. The prices valid at the time of the conclusion of the contract apply to the customer. However, if there are obvious invoice or typing errors, SAYNQUE GmbH is entitled to withdraw from the contract. If an item cannot be delivered despite the conclusion of the contract, the customer can also withdraw from the contract and will be refunded the purchase price already paid.
4. Payment
The customer can pay by credit card, TWINT, Postcard or Paypal. If the return is correct, the purchase price will be refunded to the customer. The return policy can be found on the website.
5. Obligations of the company
After SAYNQUE GmbH (‘AYRE’) has handed over the ordered product to the transport company, it has fulfilled its obligation. From this point on, the customer bears the risk of possible loss of the ordered product during shipping. SAYNQUE GmbH (‘AYRE’) does not accept any liability for errors that the transport company may cause.
Deliveries should arrive at the customer's premises within 2-4 working days. However, this period is not guaranteed by the company. Delivery costs are CHF 9, but for purchases over CHF 130, postage is included for customers within Switzerland. If products show defects, the customer must report this to SAYNQUE GmbH immediately after delivery. If the defects are proven, SAYNQUE GmbH will arrange a replacement or a refund of the amount paid. However, if the defects are due to circumstances beyond the company's control, such as force majeure, natural wear and tear, improper handling of the product, interference by third parties or excessive use of the product, they are not covered by the warranty.
6. Intellectual property rights
It is prohibited to reuse, publish or make available information, images, texts or other content provided under these terms and conditions without the express permission of SAYNQUE GmbH (‘AYRE’). The aforementioned company SAYNQUE GmbH owns all rights to its (‘AYRE’) products.
7. Data protection
The company may process and use the data collected in the context of the conclusion of the contract in order to fulfil the obligations arising from the contract. The company shall take the measures necessary to secure the data in accordance with the statutory provisions. The customer declares that he/she is in full agreement with the storage and contractual utilisation of his/her data by the company and is aware that the company is obliged and entitled to disclose information from the customer to these or third parties at the request of courts or authorities. If the customer has not expressly prohibited it, the company may use the data for marketing purposes and pass it on to its partners for advertising purposes. The data necessary for the performance of the service can also be passed on to contracted service partners or other third parties.
Furthermore, the data protection regulations apply.
8. Amendments
These General Terms and Conditions may be amended by the Company at any time.
The new version shall enter into force upon publication on the Company's website.
In principle, the version of the GTC in force at the time of the conclusion of the contract shall apply to the customers, unless the customer has agreed to a newer version of the GTC.
9. Severability clause
Should any provision of this contract or any attachment to this contract be or become invalid, this shall not affect the validity of the rest of the contract. The parties to the contract shall replace the invalid provision with a valid provision that comes as close as possible to the intended economic purpose of the invalid provision. The same shall apply to any gaps in the contract.
10. Force majeure
If timely performance by SAYNQUE GmbH, its suppliers or involved third parties is impossible due to force majeure, such as pandemics, natural disasters, earthquakes, volcanic eruptions, avalanches, storms, thunderstorms, wars, riots , civil wars, revolutions and uprisings, terrorism, sabotage, strikes, nuclear accidents or reactor damage, SAYNQUE GmbH is released from the fulfilment of the affected obligations during the period of force majeure and for a reasonable start-up period after its end. If the force majeure lasts longer than 30 days, the company can withdraw from the contract. Any further claims, in particular claims for damages due to vis major, are excluded.
11. Governing law / Jurisdiction
These terms and conditions are subject to Swiss law. Unless mandatory statutory provisions require otherwise, the court at the registered office of SAYNQUE GmbH is responsible. The United Nations Convention on Contracts for the International Sale of Goods (SR 0.221.221.1) is explicitly excluded.
